TERMS AND CONDITIONS OF SALE
1. Price List - This price list supersedes all previous price lists. 2. Interpretation - In these terms: “Supplier” means the firm of Western Australian Sinkers (hereinafter referred to as WA Sinkers) “Customer” means the person, firm or company who purchases or has agreed to purchase goods from the supplier. “Goods” shall mean any item whatsoever sold and or delivered by the supplier to the customer. “Pb” refers to sinkers that are manufactured out of lead. “Fe” refers to sinkers that are manufactured out of iron. “Terms” means these trading terms and conditions of sale. 3. Goods and Services Tax (GST) - All prices in this price list are exclusive of any GST. GST shall apply to all tax invoices and/or statements. 4. Terms of Payment - Strictly nett thirty (30) days from the end of month on the basis of an approved thirty (30) day credit application or otherwise on a strictly C.O.D. (cash on delivery) basis, in which case no approved credit application is necessary. 5. Freight Charges - All goods over $200.00 in value exclusive of GST will be delivered free into store if delivered within a radius of 20 kilometres from the GPO in Perth. Any orders delivered to customers outside a radius of 20 kilometres from the GPO in Perth shall be for customers account. Please specify preferred carrier. 6. Title - Legal and beneficial ownership of the goods shall not pass to the customer until such time as the goods have been paid in full in cash or cleared funds. 7. Right to Enter Premises - In the event that the customer is unable to or refuses to pay for goods received after the due date and a final demand has been made the customer authorizes the supplier to enter onto and to remain in and on any premises where the goods are located in order to collect the goods without being guilty of any manner of trespass and also assigns to the supplier or the suppliers agents or representatives all of the customers rights to enter onto and remain in and on such premises until all the goods have been collected. 8. Risk and Insurance - The goods are entirely at the risk of the customer from the moment of delivery to the customers point of delivery or on collection, even though title in the goods has not passed to customer at that time. 9. Claims and returns - Unless the customer has inspected the goods and given written notice to the supplier within two (2) days after collection or delivery that the goods do not comply with the relevant specifications or descriptions, the goods are deemed to have been accepted in good order and condition. 10. Severability - If any condition contained in these Terms is held by a court to be unlawful, invalid or unenforceable, the validity and enforceability of the remaining provisions are not affected. 11. Governing Law - These terms and conditions shall be governed by the Law of Western Australia and the parties submit to the courts of western Australia in respect of any disputes arising.
WARNING! - A number of sinkers in the price list contain lead (Pb) and are to be used for fishing purposes only. Low toxicity in the solid form. Can cause poisoning of an accumulative nature if ingested. If swallowed seek medical advice.
